Remedies and Defences for Copyright Infringement Under the Nigeria Copyright Act Cap C28 Laws of the Federation of Nigeria 2004: A Comparative Analysis (Published)

The primary function of copyright under the law is to protect from annexation the fruits of a person’s work. Various justifications have been put forward for this protection, the basic reasons being that a man should own what he produces or brings into being; for if what he produces can be taken away from him, then he is not better than a slave. It is the aim of this paper to focus on a critical appraisal of the copyright enforcement provisions (specifically the remedies and defences available in an action for infringement) under the Nigerian Act.
